Dear Volunteer,

You must READ (below) and AGREE TO this Release Form before participating in the Don Valley Parkway Roadside Clean Up on June 4th in Toronto. Thank you for your cooperation.

I freely choose to participate in the Don’t Mess with the Don (“DMWTD”) Don Valley Parkway Roadside Clean Up, also known as Don Valley Clean Up (“Cleanup”), and I understand and agree to the following:

(1)    I will take part in and follow the safety instructions by DMWTD crew members (“DMWTD Crew”) at the start of the Cleanup, and follow any instructions by DMWTD Crew during the Cleanup for ensuring my and other Cleanup participants’ safety.

(2) That while DMWTD Crew may provide me with safety suggestions for the Cleanup (“Safety Suggestions”), such Safety Suggestions are in no way comprehensive of any and all possible risks that may arise from my participation in the Cleanup nor are the Safety Suggestions guaranteed methods for preventing injury. I am solely responsible for my safety and wellbeing during my participation in the Cleanup and will take safety precautions to the best of my ability;

(3) That at no point during during the Cleanup, will I go onto or attempt to clean up garbage from the Parkway itself or the ramps leading to the Parkway;

(4) I will obey all traffic and pedestrian laws and will not interfere with or attempt to stop vehicular traffic;

(5) I will not go onto or attempt to cross any railway tracks outside of the official railway crossings, and that I will obey all traffic and pedestrian laws;

(6) That I will refrain from picking up any hazardous material, such as sharp or broken glass, syringes or chemical waste. I understand that hazardous materials are to be handled by DMWTD crew members only;

(7)   That participation in the Cleanup requires physical effort and involves risks and hazards, some of which are predictable in nature but some of which may be unanticipated. Knowing all this, I choose to participate in the Cleanup. I knowingly and voluntarily assume all risks of accident, damage and/or loss to my person or property as a result of my participation in the Cleanup;

(8)  That my participation in the Cleanup is strictly on a volunteer basis, and I am not entitled to any compensation or benefit from DMWTD and/or any of the Cleanup sponsors;

(9)   That in consideration of DMWTD allowing my volunteer participation in the Cleanup, I hereby release and forever discharge DMWTD,  its organizers, all Cleanup sponsors, any other participating volunteer organizations and DMWTD’s officers, directors, agents, volunteers, representatives, independent contractors and/or employees (“DMWTD Released Parties”) from any and all actions, demands, damages, expenses, attorney fees and claims and/or counterclaims of any kind or nature, whether known or unknown, including but not limited to any claims of negligence, arising out of or in any way connected with my participation in the Cleanup which I, or my heirs, executors, administrators or assigns, may have or might in the future have against DMWTD Released Parties;

(10)  That also in consideration for my participation in the Cleanup, I hereby agree to indemnify and hold harmless the DMWTD Released Parties from any and all actions, demands, damages, expenses, attorney fees and claims and/or counterclaims of any kind or nature, whether known or unknown, including but not limited to any claims of negligence, arising out of or in any way connected with my participation in the Cleanup that any person had, now has, may have or might in the future have against the DMWTD Released Parties and

(11) That, furthermore, in consideration for my participation in the Cleanup, I grant and convey to DMWTD and its representatives, licensees and assignees, all of my right, title and interests in any and all photographs, images, videos or audio recordings of me or my likeness or voice made, by DMWTD, a DMWTD volunteer, local media agencies or an observer of the Cleanup, in connection with my participation in the Cleanup.

I HAVE READ THIS ENTIRE PARTICIPATION, RELEASE OF LIABILITY, INDEMNIFICATION AND IMAGE RELEASE FORM, I UNDERSTAND AND ACCEPT ITS TERMS AND CONDITIONS, AND I VOLUNTARILY SIGN THIS FORM.
